The terms and policies stated below apply to all activities between you and
Bernaerts Music BV, business company with VAT number BE 0446.309.668:
1. The purchase
1.1. By submitting the order, you make a binding offer for the conclusion of a purchasing contract.
1.2. The offer is accepted by us when we supply the goods. The automatically generated confirmation email for the order does not yet constitute an acceptance of the order, but confirms the fact that the order has arrived with us.
We are free to decide whether we accept an order or not. If we will not execute an order, we will communicate this to you immediately.
1.3. The right of withdrawal is a statutory period of 14 days which does not apply to our orders as the goods ordered are produced specially for you via “printing on demand” system.
2. Prices and payment methods
2.1. Prices can be modified without prior notification.
2.2. The prices indicated at the time of the order shall apply.
2.3. The payment methods offered for each country on our website will exclusively apply.
3. Competent Courts
3.1. All disputes will be settled by the Courts of the judicial district of Bruges, Belgium.
4. Retention of ownership
4.1. The goods remain our property until the invoice has been paid in full.
5. Copyright and trademark
5.1. The complete contents of the website including texts, charts/graphics, photographs, images, moving images, sounds, MP3’s, illustrations, sample scores and software are our property.
5.2. This content is protected by copyright or by other rights.
5.3. They can only be used with our explicit and written consent.
5.4. All trademarks used on our website are our trademarks. They cannot be used without our prior written permission.
6. Incorrect deliveries
6.1. In the case of an incorrectly shipped product, incorrect instrumentation or any such mistake: please do not open the plastic foil! Music publications and CDs without the foil will not be accepted for copyright reasons.
6.2. Never return goods without first contacting our customer service in order to find the best arrangement for both parties.
6.3. Complaints or remarks are to be communicated in writing using our contact form within 24 hours after having received your order.
7. Extra scores & parts
7.1 The purchase of extra scores or parts is of course intended to replace lost copies or to purchase several copies if larger quantities are required.
Bernaerts Music BV reserves the right, if the original and complete work has never been purchased, to cancel your order and in case you have already downloaded it, to inform the copyright society of your country.
7.2 If you need several scores for a contest, for example, this is of course perfectly possible. Again, Bernaerts Music BV reserves the right to check this.
8. Digital downloads
8.1 A PDF or MP3 that has been purchased via download is saved in your Bernaerts Music account and can be downloaded maximum 2 (two) times. The download link is valid for 60 days only.
8.2 If purchased downloads are not downloaded by the customer within the strict period of 60 (sixty) days, he cannot claim new or replacement files under any circumstances.
8.3 Bernaerts Music BV cannot be held responsible for lost files (e.g. due to poor storage or computer crash) or if no backup was made.
